1. Scope of This Policy

This policy applies to copyright complaints involving material made available through stylishher.shop, including:

  • Product photographs and other images.
  • Artwork, graphics, illustrations, and visual designs.
  • Written descriptions, articles, and other text.
  • Videos, audio, or multimedia content.
  • Other original works protected by copyright law.

Trademark, trade-dress, patent, counterfeit-product, or design-right complaints should be submitted under our Intellectual Property Claim Policy rather than this DMCA policy.

2. Who May Submit a DMCA Notice

A DMCA notice should be submitted by:

  • The copyright owner.
  • A legal representative of the copyright owner.
  • An agent authorized to act on the copyright owner’s behalf.

A person submitting a complaint for another party should have sufficient authority to make the required legal statements on that party’s behalf.

3. Required Contents of a DMCA Takedown Notice

To help us locate and evaluate the reported material, a written DMCA notice must include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If the notice covers multiple copyrighted works, it may provide a representative list of those works.
  3. Identification of the material claimed to be infringing, together with information reasonably sufficient for us to locate it. Please provide the exact URL of each disputed page, image, or product listing.
  4. Contact information reasonably sufficient for us to reach the claimant, including the claimant’s full name, mailing address, email address, and telephone number where available.
  5. A statement that the claimant has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that the claimant is the copyright owner or is authorized to act on the copyright owner’s behalf.

4. Suggested DMCA Statements

A notice may include statements substantially similar to the following:

“I have a good-faith belief that the use of the material described in this notice is not authorized by the copyright owner, its agent, or the law.”

“I state under penalty of perjury that the information in this notice is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner.”

Email: support@stylishher.shop

Subject: DMCA Copyright Infringement Notice

Please include all required information in one email where reasonably possible. A notice that does not contain the required information may be delayed or may not be actionable.

6. Our Review and Response

After receiving a sufficiently complete notice, we may:

  • Confirm that the reported material can be located.
  • Review the notice for the required information.
  • Request clarification or additional documentation.
  • Remove or disable access to the disputed material where appropriate.
  • Notify the person or party responsible for the affected material.
  • Preserve relevant records where reasonably necessary.

Removal of material during the notice process does not necessarily constitute an admission that infringement occurred.

7. Incomplete or Invalid Notices

We may be unable to process a complaint that:

  • Does not identify the copyrighted work.
  • Does not provide an exact or reasonably identifiable URL.
  • Does not include the required legal statements.
  • Does not include claimant contact information.
  • Concerns only a trademark, product design, patent, or another non-copyright issue.
  • Is otherwise materially incomplete, fraudulent, or unintelligible.

Where practical, we may ask the claimant to correct or complete a deficient submission.

8. DMCA Counter Notification

If material you provided was removed or disabled because of a DMCA notice and you believe the removal resulted from a mistake or misidentification, you may submit a written counter notification.

A counter notification should be used only when you have a good-faith basis to believe that the material was removed or restricted incorrectly.

9. Required Contents of a Counter Notification

A valid counter notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification.
  4. Your full name, mailing address, telephone number, and email address.
  5. A statement consenting to the jurisdiction of the appropriate United States Federal District Court and accepting service of process from the person who submitted the original DMCA notice or that person’s agent.

10. Suggested Counter-Notification Statements

A counter notification may include statements substantially similar to:

“I state under penalty of perjury that I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.”

“I consent to the jurisdiction of the appropriate United States Federal District Court and will accept service of process from the person who submitted the original notification or that person’s agent.”

11. Counter-Notification Procedure

A complete counter notification should be emailed to

support@stylishher.shop

using the subject:

DMCA Counter Notification

If the counter notification satisfies the applicable requirements, we may provide a copy to the original claimant.

Where legally appropriate, the disputed material may be restored not fewer than 10 and not more than 14 business days after the counter notification is forwarded, unless the original claimant informs us that legal action has been filed seeking a court order concerning the disputed material.

12. Misrepresentation

Do not knowingly make a material misrepresentation in a DMCA notice or counter notification.

Under applicable law, a person who knowingly and materially misrepresents that material is infringing, or that removed material was removed by mistake or misidentification, may be responsible for resulting damages, costs, and attorneys’ fees.

13. Repeat Infringement

Where appropriate and under suitable circumstances, Stylishher may restrict or discontinue access, listings, content submissions, or business relationships associated with repeated copyright infringement.

Decisions will be based on the available notices, counter notifications, supporting evidence, surrounding circumstances, and applicable law.

14. Information Sharing

Information included in a DMCA notice or counter notification may be shared with:

  • The person responsible for the disputed material.
  • The original claimant.
  • Relevant service providers.
  • Legal advisers or insurers.
  • Courts, government authorities, or other parties where legally required.

Do not include personal information that is unnecessary for evaluating or processing the complaint.

15. No Legal Advice

This policy describes our process for receiving and handling copyright complaints. It does not constitute legal advice or determine whether particular material infringes a copyright.

If you are uncertain whether material is infringing, authorized, licensed, subject to fair use, or otherwise legally permitted, consider consulting a qualified legal professional before submitting a notice or counter notification.

16. Changes to This Policy

We may update this DMCA Copyright Policy to reflect changes to our website, internal procedures, contact information, or applicable legal requirements.

The revised version will be published on this page with an updated revision date.
